Dear Sirs,

I am an administrator on the Dutch Wikipedia and writing to you in that role.

One of our users, nicknamed Gebruiker:Piero has published some 33 images on the Dutch Wikipedia from your site with a reference to a permission given by you or possibly a previous maintainer of the website. Most of these images were added to the site beween January 2005 and April 2005. We have no proof of this permission ever having been given and the images will be removed from the encyclopedia if this matter is not cleared. I wish you can help me with that.

The exact text is (translated): "Permission from [http://www.users.globalnet.co.uk/~pattle/nacc/arcframe.htm (The NACC Archives)". To this he attaches the claim that you have given permission to use the images with a license of either en:Public Domain or "Can be used with restrictions", without actually stating which restrictions for use should be applied.

I have a few questions I hope you could answer:

• Do you actually own copyright to the images which reference back to you?
• If you do own copyright, could you indicate if you have ever given permission to use these images elsewhere?
• If you have given permission, can you give me a copy of the given permission, as well as proof of owning the copyrights to the images?

Sorry, but I can't give you a simple answer. I presume the pictures are all taken from the Photo Gallery section of the NACC Archives site. At the moment, the Gallery contains over 360 pictures from a variety of sources. Most will have been taken by members of our club and given to the NACC on the understanding that we are free to publish them as we please. Some are taken from manufacturer's publicity material, in which case the copyright still belongs to the manufacturer (though in several cases the manufacturing company no longer exists). Others are pictures that we have been given permission to use on our website, but do not have permission to grant a licence for others to use them. There are also a few old pictures that are out of copyright.

Our club has been in existence for over 25 years and over that period, the photo library has been looked after by several people - on some of the older pictures, we have no documentation and, therefore, don't know who took them.

On the NACC archive site we have put an attribution when we definitely know who took the photograph. Where my own name (Andrew Pattle) is there as the photographer, I grant permission for them to be used provided there is an acknowledgment of the source of the photo. Many pictures were taken by Mark Daniels. I am sure that he would be willing to grant permission too - if you need to ask him directly, his e-mail address is mark <at> mdhercules <dot> fsnet <dot> co <dot> uk

Pictures attributed to "Smiths Autocycles" or "Peter Smith" may not be reproduced.

Any other pictures from our site will have to be dealt with individually.

Ik ga een mail terugsturen met de vraag onder welke licentie Andrew zijn afbeeldingen wil vrijgeven en ik ga Mark Daniels benaderen met de vraag of en zo ja, onder welke licentie, hij zijn afbeeldingen vrij gaat geven. Voor de overige afbeeldingen ga ik controleren of het mogelijk is vast te stellen en/of in te schatten hoe oud ze zijn.
